Terms of Service

1. Age Requirement & Eligibility

WaifuVerse contains content intended for adults, including AI-generated imagery, mature themes in AI companion interactions, and user-generated content. We are committed to preventing minors from accessing the platform. If we discover that a user is under 18, we will terminate the account immediately and delete all associated data.

You also represent that your use of the Service does not violate any applicable laws or regulations in your jurisdiction. It is your responsibility to ensure that accessing WaifuVerse is legal where you are located.

2. Account Registration

To access most features of WaifuVerse, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password confidential and not share your account with others
• Immediately notify us of any unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

You may not create an account using a false identity, impersonate another person, or create accounts for purposes other than lawful use of the Service. We reserve the right to refuse registration or cancel accounts at our sole discretion.

3. Description of Service

WaifuVerse provides:

• AI Image & Video Generation Tools: Generate anime-style images and animations using AI models.
• Waifu Image Aggregator: Browse and collect anime character images.
• Doujinshi Repository: Access translated doujinshi content.
• AI Companion Chat: Interactive conversations with AI character companions.
• AI Tools: Translation, colorization, animation, and other content processing tools.
• Games: Including Mecha Musume Moba and Waifu Lock.
• Social Features: Profiles, collections, community interaction, and leaderboards.
• Digital Collectibles: Character NFTs and collectible items.
• Creator Tools: Content creation and monetization features.

4. Acceptable Use Policy

You agree to use WaifuVerse only for lawful purposes and in accordance with these Terms. You are strictly prohibited from:

Illegal Content

• Uploading, generating, or distributing any content that depicts, describes, or promotes sexual acts involving minors (CSAM) — this is a zero-tolerance violation that will result in immediate account termination, data preservation, and reporting to law enforcement
• Distributing content that is illegal under applicable laws, including non-consensual intimate imagery ("revenge porn")
• Engaging in or facilitating illegal activities of any kind

Harmful Conduct

• Harassing, threatening, or abusing other users
• Posting content that incites violence or hatred against individuals or groups
• Attempting to hack, reverse engineer, or disrupt the platform or its infrastructure
• Uploading malicious code, viruses, or any software designed to harm
• Using automated tools, bots, or scripts to scrape or abuse the platform without written permission
• Circumventing rate limits, credit systems, or access controls
• Impersonating another person or entity, including WaifuVerse staff

Intellectual Property

• Uploading content you do not own or have rights to
• Infringing on third parties' copyrights, trademarks, patents, or other intellectual property rights

Platform Integrity

• Attempting to circumvent subscription tiers, payment systems, or access controls
• Creating fake accounts or manipulating engagement metrics
• Reselling or redistributing the Service without authorization
• Using the Service to generate spam, phishing content, or deceptive material

We reserve the right to determine what constitutes a violation of this policy at our sole discretion and to take appropriate action, up to and including permanent account termination.

5. Credits, Payments & Subscriptions

5.1 Credits System

The Service uses a credit-based system for AI generation and premium features. Credits may be purchased or earned through platform activities. Credit prices and packages are displayed at time of purchase. Credits are non-transferable between accounts unless explicitly permitted.

5.2 Subscriptions

WaifuVerse offers free and paid subscription tiers. Paid tiers unlock additional features. Subscriptions are available via Patreon, SubscribeStar, Fanvue, or direct purchase. Subscriptions auto-renew unless cancelled before the renewal date. Cancellation takes effect at the end of the current billing period. Feature availability by tier is subject to change with reasonable notice.

5.3 Cryptocurrency Payments

We accept payments in cryptocurrency (ETH, SOL, BTC). By making a crypto payment, you understand and agree that:

• Cryptocurrency transactions are irreversible once confirmed on the blockchain
• You are solely responsible for sending funds to the correct wallet address and network
• WaifuVerse is not responsible for funds sent to incorrect addresses or on incorrect networks
• Subscription activation is subject to blockchain confirmation, which may take time
• Cryptocurrency values are volatile; you agree to pay the stated crypto amount at the time of transaction regardless of USD value fluctuations

5.4 Refund Policy

Unused credits may be eligible for refund within 14 days of purchase if no generations have been made. Subscription fees are non-refundable for the current billing period after services have been rendered. Due to the irreversible nature of cryptocurrency transactions, all crypto sales are generally final. Exceptions may be made at our sole discretion for technical errors on our part. Refund requests should be sent to support@waifuverse.net within 7 days of the transaction. We reserve the right to deny refunds in cases of abuse or Terms violations.

6. AI-Generated Content & Character Interactions

WaifuVerse provides AI-powered interactive character experiences. You acknowledge and agree that:

• AI companions are fictional characters. They are not real people, do not have consciousness, feelings, or legal personhood, and do not represent any real individual.
• AI responses are generated by language models and may be inaccurate, inconsistent, or unexpected. You should not rely on AI character responses for medical, legal, financial, psychological, or safety advice.
• Responses generated by AI are not reviewed in real time by WaifuVerse staff. You interact with AI companions at your own discretion.
• You will not attempt to use AI character interactions to facilitate harm to yourself or others, extract harmful instructions, or engage in activities prohibited by these Terms.
• WaifuVerse reserves the right to modify AI character personalities, capabilities, and responses at any time.

Conversation data may be used to provide and improve the Service as described in our Privacy Policy. We do not guarantee the confidentiality of AI conversations; do not share sensitive personal information in chats.

7. User-Generated Content

Your Content, Your Responsibility

You retain ownership of original content you create and upload to WaifuVerse. By uploading content, you grant WaifuVerse a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, display, distribute, and process your content solely for the purpose of operating and improving the Service.

Content Standards

All content you upload must comply with our Acceptable Use Policy (Section 4) and applicable laws. You represent and warrant that:

• You own or have all necessary rights to upload the content
• The content does not infringe on any third party's intellectual property rights
• The content does not depict real, identifiable individuals without their consent in a sexual, harmful, or defamatory manner

AI-Generated Content

Images and content generated using our AI tools are created by you using the Service. You are granted a license to use AI-generated content for personal and commercial purposes, subject to these Terms. You are responsible for the prompts and inputs you provide and for ensuring your use complies with applicable laws. WaifuVerse does not claim ownership of AI-generated content created by users. We reserve the right to use anonymized, aggregate generation data to improve the Service.

Public vs. Private Content

You may choose to make your uploaded content public or private. Public content may be viewed by all users and may be indexed. You are responsible for ensuring any content you make public complies with these Terms.

Takedowns

We reserve the right to remove any content that violates these Terms without prior notice and at our sole discretion. Repeated violations may result in account termination.

8. Intellectual Property

8.1 WaifuVerse Platform

The WaifuVerse platform, including its software, design, logos, AI character artwork, names, game assets, and original content, is owned by or licensed to WaifuVerse and protected by intellectual property laws. Nothing in these Terms grants you any right to use our intellectual property except as expressly permitted.

8.2 Character IP & Fan Content

The original WaifuVerse character roster (Hikari, Aurora, Kitsune, Lilith, and others) are proprietary characters of WaifuVerse. You may not reproduce, distribute, or commercialize these characters without written permission. WaifuVerse original characters may be used in non-commercial fan content with attribution. Commercial use of WaifuVerse character IP requires prior written permission. Third-party character content on the platform is the responsibility of the uploading user.

8.3 DMCA & Copyright Complaints

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, submit a takedown notice to dmca@waifuverse.net including:

• Identification of the copyrighted work claimed to be infringed
• Identification of the infringing material and its location on our platform
• Your contact information
• A statement of good faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

We will respond to valid DMCA notices and remove infringing content as required by law.

9. Third-Party Services

The Service integrates with third-party platforms including payment processors (Stripe, PayPal), authentication providers (Google), social platforms (Discord, Patreon, SubscribeStar, Fanvue), AI model providers, and cloud infrastructure providers. Your use of third-party services is subject to their respective terms and privacy policies. WaifuVerse is not responsible for third-party services.

10. Disclaimers & Limitation of Liability

Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED SERVICE. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE.

AI Disclaimer

AI-generated content, including character responses, images, and animations, is produced by automated systems. We make no representations about the accuracy, appropriateness, or quality of AI outputs. You assume full responsibility for how you use and interpret AI-generated content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WAIFUVERSE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

Indemnification

You agree to indemnify, defend, and hold harmless WaifuVerse and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, your violation of any third-party rights, or content you create, upload, or distribute through the Service.

11. Account Termination

You may delete your account at any time through your account settings or by contacting us.

We may suspend or permanently terminate your account, without prior notice or liability, if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in fraudulent, abusive, or illegal activity
• Attempt to harm the platform, its users, or third parties
• Fail to pay for services owed

Upon termination, your right to use the Service immediately ceases. Content you have uploaded may be deleted. Provisions of these Terms that by their nature should survive termination (including Sections 7, 8, 10, and 12) shall survive.

12. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions.

Informal Resolution First

Before initiating any formal proceedings, you agree to contact us at legal@waifuverse.net and give us 30 days to attempt to resolve the dispute informally.

Binding Arbitration

If informal resolution fails, any dispute arising from or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall take place on an individual basis — you waive your right to participate in a class action lawsuit or class-wide arbitration.

Exceptions

Either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm, and claims for CSAM or other serious criminal conduct may be brought in any court of competent jurisdiction.

13. Changes to These Terms

We may revise these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify you via email or a banner on the platform at least 14 days before changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

14. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the entire agreement between you and WaifuVerse regarding the Service and supersede all prior agreements.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely.
• Force Majeure: We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government action, infrastructure failures, or third-party service outages.
